Lemon Law Claim

What was the final resolution to this? With 18'000 miles you've certainly still been able to use it.

It got accepted by WA state (where I purchased) for arbitration with Lotus. So will see where that goes..

Lotus did not respond to my letter so this was the next step. I’m worried that others haven’t experienced issues just because of their low miles. And yes I’ve gotten use out of it. Doesn’t negate the fact that it’s been incredibly tedious and problem ridden and not what should be the experience for a 100k+ car

Any update?

Some of us have experienced issues and I am going through the Lemon Law route as well. I'm not sure what I can or cannot talk about, but simple facts.

Started a claim through Letter in early August. No response from Lotus. Required lawyer intervention. Terms are agreed, but I'm still waiting on payment and still have my Emira in my driveway that I'm still paying insurance on. I'm hoping this closes in the next month.

TLDR, you need a lawyer, expect the process to drag on, but it is a legitimate way to go.

Figured I would also throw my experience in here. I went through the BBB to file my claim. I bought my car in march and it has been in the shop around 110 days and counting. BBB took my case at the end of September. Lotus provided 0 documents to the BBB case. BBB arbitration happened at the end of November and surprisingly they showed up but very poorly prepared. BBB ruled in my favor and I was told that I was going to get the car repurchased from me no later than January 12th (next Monday). Unfortunately ever since the arbitration, Lotus has not responded at all to either me or the BBB. I asked the BBB rep what happens if that date comes and goes. He said that there’s really nothing that I can do other than go after their necks with lawyers.

The unfortunate reality for me is that after the third attempt at fixing the car (and thinking it was fixed) I didn’t drive it at all. I worked out a deal with a dealership to buy the car from me. I went and bought a gt4rs and the next day went to take the lotus to the dealership that was going to buy it from me. Once they put it on the lift they saw it was leaking for the fourth time and that’s how this whole mess started. Unfortunately for me that means an extra expensive payment on the 4rs (was going to use lotus funds to get the payment lower), the lotus payment, and my daily driver payment. Not to mention insurance on them all. Lotus has to know the longer they drag this out the worse it gets for me. Or they just haven’t paid any attention or mind to it. Probably the latter.

Regardless, I really want to stick up for lotus but after this process I don’t think I’ll ever even look at a lotus. They seemingly can’t stop shooting themselves in the foot. Just some basic communication would do wonders for consumers like myself.

Thanks to the others who have shared their experiences. I can provide an update/recap on my situation.

Now 140+ days since I first dropped off my Emira at service in August for a fuel pressure sensor related CEL and after a new sensor, ECM, and Engine Harness - the car's still throwing a CEL after test drives. I know many Lotus dealers don't offer loaners but mine does and I've had to take the first loaner back because it became over due for service and I got swapped out to a different loaner (which will also need to go back within 60 days because I'd be driving on expired registration tags starting in March) - this is all a bit sad and funny. Saw my car for the first time in months and it looked dusty and dirty and sad.

On the legal front I had asked a few firms initially (after 45 days had passed) and they all said I had a case (in October) and I signed on with a firm who filed suit against Lotus late October. But here's a timeline that's easier to digest.
  • Jan 2025 - purchased car
  • June 2025 - check engine P2541 Low Pressure Fuel Sensor malfunction
  • August 2025 - dropped off at Lotus service center
  • October 2025 - replaced sensor, CEL persists; Lemon Law Claim filed against Lotus
  • November 2025 - replaced ECM, CEL persists and found loose pin in harness; Lemon denied by Lotus, responded to initial disclosure from Lotus and seeking mediation
  • December 2025 - replaced engine wiring harness, CEL is gone for a week of testing; No acknowledgement of initial disclosure and Mediation not answered, requesting again
  • January 2026 - after a week of testing, CEL returns, needs further diagnosis; Loaner due for service, swapped for a different loaner, still have days left before the deadline for Lotus to acknowledge the initial disclosure and Mediation. (I'm certain the time will pass and I'm not sure if a judge gets involved or what)
I'll be paying my registration renewal soon and insurance continues to be paid (if I got rid of the loaner vehicle, I had considered significantly lowering my insurance temporarily). Like others, I want to root for Lotus. This situation makes zero sense that they'd continue to spend time and money diagnosing and throwing parts at my car and also eventually footing the dealership bill to cover my loaner...buy it back and we'll all move on.
