Was your deposit non-refundable? If it wasn't, then it wasn't a deposit, it was an order which moves it from a place holder (which is really what a deposit is) to a contract and they are bound by the terms whether they like it or not.

You say after over night on the tender the problem goes away... just as a wildcard guess, try putting the battery on an actual battery charger, not a tender, and give it a full actual charge instead of a maintenance trickle charge. See if that fixes it.

By any chance are you guys running gas above E10? Like E15, E20 or E85? That's a possible source of injector fouling.

Be aware that Lotus specifically states in the manual to NOT use fuel with more than 10% ethanol. The warning seems to concern the fuel system, not the engine, which means the fuel system components are not made of the materials that can resist the corrosive effects of ethanol, and E85 is 85%...

Just out of curiosity I looked into E85 gas which I know is popular with tuners, and the Emira is not listed as a Flex Fuel car. It's rated for E5 or E10, but the manual specifically states to not put more than a 10% mix of ethanol in the car.
