Should the P2CEF failed thermostat/sand in cooling be a recall issue?

I’m just concerned that this will result in long term issues or future engine replacement. Should Lotus buyback vehicles with this issue?
 
We are covered by Lemon Law in US.

Has it been officially confirmed by Lotus that a group of us have sand in the coolant system? Could it just be a bad batch of Thermostats?
 
It’s at least four on this forum alone maybe more. I absolutely love the car. I just want to know this can be resolved and not a reoccurring issue or a complete engine replacement.
 
Among all the potential issues the Emira has - across all variants - I think it's important to drive and enjoy them as much as possible in the first year or two of ownership. Not that you should stop afterwards, but it seems, so far, most issues present themselves within the first few thousand miles and 2 years. Lotus will likely just do the legal minimum required of them because they are losing a ton of money as a company.
 
In regards to Lemon Law legal minimums, based on some comments about repair times, Lotus are failing to meet even that.

30 calendar days out of service in the first two years and Lotus / dealer must buy back the car at full price if the customer wants (in my state).

I'm at 10 calendar days and counting waiting for a simple thermostat replacement...
